Terms of Service
These Terms govern your use of the OnCallAI Pro website and of the AI receptionist and automation services we provide. By using the site or the services, you agree to them.
The service
OnCallAI Pro builds and operates an AI phone receptionist configured to a client's business. Depending on the agreed setup, it may answer calls, answer questions from information the client supplies, book appointments into the client's calendar, transfer calls, and provide call summaries.
The specific scope, pricing and term for each client are set out in that client's service agreement. Where these Terms and a signed service agreement conflict, the service agreement governs.
Your responsibilities as a client
- Give us accurate information about your hours, services, pricing and policies. The receptionist only knows what you tell it.
- Review and approve your receptionist's configuration before it goes live, and tell us promptly when something needs to change.
- Make any disclosures your industry or state requires, including call recording disclosures and any regulated-industry notices.
- Use the service lawfully. You may not use it for unlawful, deceptive, harassing or fraudulent purposes.
- Maintain the phone service and calendar accounts the receptionist depends on.
What we don't promise
The service depends on telephone networks, speech recognition and third-party providers. We work hard to keep it running, but we do not guarantee uninterrupted or error-free operation, and we do not guarantee any particular business outcome, booking rate or revenue.
The receptionist is not a person. It can misunderstand a caller. It is configured to say so and hand off when it isn't sure, but you should review your call logs and tell us when something needs correcting.
The service is not a substitute for emergency services. It is not designed to handle 911 or life-safety calls, and must not be presented to callers as if it were.
Fees and cancellation
Fees, billing frequency and any notice period are set out in your service agreement. Unless that agreement says otherwise, service is month to month with no long-term contract, and either party may cancel with notice as described there. Fees already paid for a completed period are non-refundable unless we agree otherwise in writing.
Ownership
You own your business information, your customer data, and the call recordings, transcripts and appointment records generated for your business. We own the software, prompts, workflows and templates we use to build and operate the service, including improvements we make to them.
You grant us the limited right to process your data to provide and improve your own receptionist.
Confidentiality
Each of us will keep the other's non-public business information confidential and use it only to perform under these Terms.
Limitation of liability
To the fullest extent permitted by law, OnCallAI Pro is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost business or lost data. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the event giving rise to the claim.
Indemnity
You agree to indemnify us against claims arising from your use of the service in breach of these Terms, from information you gave us that was inaccurate, or from your failure to make a disclosure your industry or state requires.
Suspension and termination
We may suspend or end the service if it's used unlawfully, if fees go unpaid, or if continuing would expose either of us to legal risk. We'll give you notice and a chance to fix it where we reasonably can.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Bexar County, Texas.
Changes
We may update these Terms. The date at the top reflects the most recent revision. Continuing to use the service after a change means you accept it.
